On the second day of the hungerstrike by oustees of Maheshwar dam, the Ministry of Environment and Forests (MoEF) issued a letter ordering the immediate suspension of the construction of the Maheshwar Dam.

Ltd. 801, 8th Floor, Ansal Bhawan 16, Kasturba Gandhi Marg New Delhi-110001 Subject: Maheshwar Hydro Electric Project (10X40 MW) in Madhya Pradesh by Shree Maheshwar Hydel Power Corporation Ltd. – Non compliance of environmental conditions stipulated in the environment clearance letter dated 01.05.2001 Sir, This has reference to the Show Cause Notice issued by the Ministry on 17th February, 2010 seeking clarification on the progress in implementation of Environmental Safeguard Measures and Rehabilitation and Resettlement and to explain why the environmental clearance should not be revoked and a direction for closer of the aforesaid project may not be issued. 2. The reply submitted by M/s Shree Maheshwar Hydel Power Corporation Ltd. Vide their letter dated 9th March, 2010 has been reviewed in the Ministry and found that the reply is not satisfactory on the following grounds:- (i) Negligible R&R work has been done. (ii) No agricultural land has been identified for rehabilitation purpose. Out of 22 submergence villages R&R is almost completed in respect of only Jalud village. (iii) Two Wildlife Sanctuaries have not been created. (iv) Backwater level calculation report of Central Water Commission which was supposed to be given in December 2009 has not yet been submitted. 3. The Central Government, therefore, in exercise of its power under Section 5 of the Environment (Protection) Act, 1986 hereby directs the project proponent to get the ongoing construction work at the Maheshwar Hydro Electric Project site suspended with immediate effect till a satisfactory compliance report on the above mentioned issues is submitted by the project proponent and the same is found to be implementable by this Ministry 4. The letter issues with the approval of the Competent Authority.
